Italian citizenship is based on the principle of ius sanguinis (blood right) by which a child born of an Italian father or mother is Italian; nevertheless, it must be kept in mind that the mother citizen has only transmitted citizenship to minor children since January 1st 1948 as a result of a ruling by the Constitutional Court. Italian citizenship is currently regulated by Law No. 91 of 5 December 1992, which, unlike the previous law, re-evaluates the importance of individual desire in the gain or loss of citizenship and acknowledges the right to hold citizenship in more than one country, except in the case of the various provisions of international agreements.

WAYS TO BECOME AN ITALIAN CITIZEN

AUTOMATICALLY

1. by having an Italian parent(s);

2. by being born in Italy:

including cases in which the parents are unknown, stateless or do not transmit their own citizenship to their child according to the legislation of the State to which they belong, as well as children found abandoned in Italy and for whom it is impossible to determine status civitatis (citizenship);

 

3. through paternal or maternal recognition while the child is a minor (in cases in

which the child recognised is no longer a minor, he/she is obliged to elect to become a citizen within one year of recognition);

4. by adoption, both if the foreign minor is adopted by an Italian citizen by means of

the Italian Judicial Authorities, as well as in the case in which adoption is granted abroad and made effective in Italy through a writ, issued by the Juvenile Court and registered with the Civil Registry.

If the adoptee is no longer a minor he/she can become a naturalised Italian citizen after 5 years of legal residence in Italy (see How to Apply: Naturalisation).

HOW TO APPLY

1. Declaration of desire to become a citizen;

If the foreigner is of Italian descent (up to the 2nd degree) he/she can obtain citizenship in any of the following cases:

– by serving in the Italian armed forces;

– by becoming a subordinate employee of the Italian State, even abroad;

– by residing legally in Italy for at least two years after reaching legal age.

If the foreigner was born in Italian territory he/she can obtain citizenship by residing legally and uninterruptedly in Italy from birth up to legal age.

2. Marriage to an Italian citizen;

The requirements include:

legal residence in Italy for at least 6 months after marriage or 3 years of matrimony if residing abroad;

3. Naturalizzazione

requirements include:

10 years of legal residence;

sufficient income;

absence of criminal record;

renunciation of original citizenship (where foreseen).

the number of years can be reduced to:

3 years of legal residence for descendents of former Italian citizens by birth, up to the 2nd degree, and for foreigners born in Italian national territory;

4 years of legal residence for citizens of European Community Member States;

5 years of legal residence for displaced persons or refugees, as well as for legal-age foreigners adopted by Italian citizens;

7 years of legal residence as the child of an Italian parent;

no period of residence is required for foreigners who have served the State for a period of at least 5 years, even abroad.

Application for naturalisation must be addressed to the President of the Republic (Presidente della Repubblica) and presented to the Prefecture in the Province of residence.

 

GETTING ITALIAN CITIZENSHIP BACK ONCE LOST

Italian citizenship can be reinstated once it is lost:
Automatically
One year from the date in which residence is established in Italy, except in the case of renunciation within that same period.

By Application

· serving in the Italian armed forces;

· being hired as a public servant at the service of the State, even abroad;

· residents abroad: providing the Italian Consulate with a statement stating the intention to reinstate Italian citizenship and establishing residency in Italy within one year of that statement;

· statement by Italian citizens who automatically lost citizenship by marrying a foreigner before January 1st 1948.

 

CITIZENSHIP BY MARRIAGE/CIVIL UNION

Beginning 05 october 2018 – per article 14 of Legislative Decree of 4 ottobre 2018, n. 113 – the processing time for applications for Italian citizenship by marriage is 48 (forty eight) months from the day that the application is accepted. This processing time also applies to any applications in progress that were accepted prior to that date.

LANGUAGE REQUIREMENTS FOR CITIZENSHIP BY MARRIAGE.

If you are applying for citizenship by marriage you need to speak Italian and you need to pass a B1 language test unless you already have certified knowledge of Italian which has been recognized by one of the institutions listed below, or if you hold a language degree in Italian:

• Università Roma Tre
• Società Dante Alighierin Italian

The foreign spouse of an Italian citizen, if resident in Italy, may apply for Italian citizenship to the Prefettura after being married for 2 years, if the couple resides in Italy, and to the Italian Consulate after being married for 3 years if the couple resides abroad.

The above periods are reduced by half if the spouses have biological and/or adopted children who are minors (under 18 years old).

Two basic requirements to be met prior to submitting the application are:
• the marriage must have already been registered at the Town Hall in Italy;
• the Italian spouse must be registered at the Consulate as an Italian Citizen Residing Abroad (A.I.R.E.).

 

DOCUMENTATION TO SUBMIT

if the couple resides in Armenia, the foreign spouse can apply throught this Embassy. The following items 1-6 must be uploaded ONLINE. Once your online application is accepted, you will be contacted by the citizenship department of this Embassy in order to submit original hard copies of ALL the following documentation.

1. ITALIAN LANGUAGE CERTIFICATION
A CERTIFICATE OF KNOWLEDGE OF ITALIAN LANGUAGE AT LEVEL B1 (or higher),  prof. Zara Voskanyan, Yerevan State University, cell. +37493527704 (WhatsApp , Viber e Telegram), e-mail zarugi@yahoo.fr

2. ESTRATTO PER RIASSUNTO DAI REGISTRI DI MATRIMONIO issued by the Comune in Italy where the marriage was registered (only an original “certificate” will be accepted, not a copy).

3. ORIGINAL BIRTH CERTIFICATE – this certificate must be sumbitted legalized with Apostille.

4. TRANSLATION INTO ITALIAN OF THE BIRTH CERTIFICATE also the translation must be legalized with Apostille

5. CRIMINAL RECORDS/BACKGROUND CHECK/CERTIFICATE OF GOOD CONDUCT issued by the Nation of origin AND every previous residency starting from the age of 14. All Criminal Certificates must be legalized with Apostille and translated into Italian Language. Also the translation must be legalized with Apostille

Sworn translation

N.B.: Criminal Records/Certificates of Good Conduct/Background Check are only valid for 6 MONTHS. Please ensure that these documents are STILL VALID when the citizenship application is submitted online.

6. STAMP OF € 16

7. RECEIPT OF PAYMENT of € 250 fee – As required by art. 14 D.L. 113 of October 4th 2018 there is a fee of € 250 to be paid by all applicants. The fee of € 250 must be paid through international bank transfer, following these guidelines:

Starting from 25 May 2022 it is possible to pay the stamp duty € 16 and / or the contribution of 250 € through PagoPA directly from the Citizenship website when the application is uploaded.

HOW TO SUBMIT THE DOCUMENTATION

Applicants interested in Italian citizenship through marriage and resident in Armenia will have to submit their application directly online (as listed below). Following the submission of the documentation, the applicant will be contacted for the deposit of the original documents and payment of the other fees.

A) Register on the webpage of the Ministry of Interior Affairs https://cittadinanza.dlci.interno.it

B) After the login, the applicant will find a “CITIZENSHIP” section containing the following subtitles:
• gestione della domanda
• visualizza stato della domanda
• primo accesso alla domanda comunicazioni

(“visualizza stato della domanda” and “primo accesso alla domanda” allow the applicant to check the status of his/her request)
By choosing “gestione della domanda” the applicant will have the possibility to submit his/her application by completing the form: MODELLO AE.

C) The applicant must complete the form in its entirety and upload the requested documentation listed on this Embassy’s website:

  • Estratto di matrimonio issued by the Municipality in Italy
  • Italian Language Certification
  • Birth certificate with Apostille and Italian translation with Apostille
  • Stamp of € 16
  • Receipt of payment of the 250 Euro fee
  • Valid passport

The applicant may save, modify, cancel or submit the completed application. After reviewing the submitted application the Consulate may:
•accept the request
•reject the application

PROCESSING TIME

Applications and all required documentation must first be submitted online. Per article 14 of the legislative decree of 04 October 2018, n. 113, processing time will be 48 MONTHS from the date the Consulate accepts the appliant’s complete online application.

Once the online application is accepted, the applicant will be contacted so that he/she may submit all original documents and necessary payments to this Embassy. You will be contacted by email at ALI portal.
